These Terms and Conditions ("Agreement") govern the relationship between you (“Client,” “you,” or “your”) and Compass Concierge Travel Co. LLC ("Agency," “we,” “our,” or “us”) as it relates to planning, booking, and facilitating travel arrangements. By booking travel services through our agency, you acknowledge and agree to the terms outlined below.

1. Scope of Services

Compass Concierge Travel Co. LLC provides personalized travel planning services, including but not limited to: itinerary design, transportation and accommodation bookings, tour and activity coordination, travel documentation guidance, and concierge recommendations. We act as a consulting and booking intermediary between you and third-party travel suppliers.

2. Third-Party Suppliers

All travel arrangements we make on your behalf are fulfilled by independent third-party suppliers (e.g., airlines, cruise lines, hotels, tour operators). Compass Concierge Travel Co. LLC is not liable for the acts, errors, omissions, warranties, representations, breaches, or negligence of these suppliers or for personal injuries, property damage, delays, or any other loss arising out of travel booked through these third parties.

3. Client Responsibility

It is the client's responsibility to:

Provide accurate information during the planning process.
Review all travel documents, confirmations, and itineraries upon receipt.
Ensure that all travelers have valid passports, visas, vaccination documentation, and any required health declarations.
Abide by the laws and regulations of the destination country.

We are happy to assist with guidance, but you are solely responsible for ensuring all legal travel requirements are met.

4. Planning Fee & Payment Terms

We charge a flat planning fee based on itinerary complexity and duration. This fee covers our time, research, and concierge services and is non-refundable once planning has begun. Final payments for travel arrangements must be made according to supplier deadlines. Failure to remit payment may result in the cancellation of your bookings.

5. Changes, Cancellations, and Refunds

Any changes or cancellations to bookings must be communicated in writing. Cancellation policies are governed by the terms of each individual travel supplier and may include fees or non-refundable deposits. We are not responsible for supplier-imposed penalties, refund delays, or refund denials. Travel insurance is strongly recommended to protect your investment.

6. Travel Insurance

We highly recommend purchasing travel insurance to cover unforeseen circumstances such as trip cancellation, medical emergencies, weather-related delays, lost baggage, or vendor default. It is your responsibility to review and understand the terms of your travel insurance policy.

7. Travel Risks & Assumption of Liability

Travel may involve inherent risks, including but not limited to illness, injury, crime, political instability, terrorism, or global health events (e.g., pandemics). By using our services, you acknowledge these risks and agree to hold Compass Concierge Travel Co. LLC harmless from any liability for personal injury, illness, property loss, or travel disruption resulting from events outside of our control.

8. Force Majeure

We are not responsible for delays or failure in performance resulting from acts beyond our reasonable control, including but not limited to natural disasters, weather events, government actions, pandemics, labor strikes, mechanical failures, or acts of terrorism.

9. Limitation of Liability

Compass Concierge Travel Co. LLC shall not be liable for any special, indirect, incidental, or consequential damages, including but not limited to lost profits, arising out of the performance or non-performance of travel services. Our total liability shall not exceed the amount of fees paid directly to us.

10. Dispute Resolution

Any dispute arising from or related to these Terms & Conditions shall first be attempted to be resolved through good faith negotiations. If unresolved, disputes shall be handled through binding arbitration under the laws of the State of Tennessee.

11. Modification & Acceptance

These Terms & Conditions may be updated at any time. Your continued use of our services following such updates constitutes acceptance of the revised terms. It is your responsibility to review this page periodically.

12. Electronic Record and Signature Disclosure

By booking travel services through Compass Concierge Travel Co. LLC, you agree to receive all documentation, agreements, terms, and legally required disclosures electronically. This includes but is not limited to: itineraries, confirmations, invoices, travel documents, waivers, and notices.

You acknowledge and consent to use electronic records and electronic signatures in place of paper documents and handwritten signatures. You agree that electronic signatures are legally binding and enforceable under applicable law.

13. Updating Contact Information

It is your responsibility to promptly inform Compass Concierge Travel Co. LLC of any changes to your email address or contact information to ensure delivery of all necessary travel communications and documents.

14. Requesting Paper Copies

While electronic delivery is the standard method of communication, you may request paper copies of any documents. Such requests must be made in writing and may require a reasonable period for processing and delivery. Additional fees for printing and mailing may apply.

15. Photography & Marketing Release

By participating in or booking travel services through Compass Concierge Travel Co. LLC (“the Company”), you acknowledge and agree that photographs and/or videos may be taken during your travel experience by the Company or its representatives for the purpose of documenting and promoting the Company’s services. You grant the Company permission to use any such media for marketing, advertising, promotional, and commercial purposes across various platforms, including but not limited to social media, websites, print materials, and digital communications.

Additionally, any photographs or videos voluntarily shared with the Company—whether by email, text, social media tagging, online reviews, or other forms of communication—may also be used by the Company for the same purposes. You affirm that you have the authority to grant this permission and that any individuals featured in the submitted media have also granted their consent.

You waive any right to inspect or approve the finished product in which your likeness or provided media appear and understand that no compensation will be provided for the use of these images or videos. If you prefer not to have your image or submitted media used, you must notify the Company in writing prior to travel or at the time of submission.

By continuing with your booking, you affirm your consent to receive communications and disclosures in electronic form, unless otherwise requested.

Acknowledgment

By booking travel services with Compass Concierge Travel Co. LLC, you confirm that you have read, understood, and agree to these Terms and Conditions.
